By entering this site, you are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Shop Terms and Conditions

By entering into an agreement to be tattooed as a scheduled client appointment or as a walk-in client with no appointment, at Outside The Box Tattoos and its artists, you the client agree to the following terms and conditions.  If you do not agree to our terms and conditions, you are welcome to be tattooed elsewhere.

Tattooing is a permanent form of art where a needle and tattoo machine is used to push ink under your skin. You will experience some pain and discomfort dependent on the area you are getting tattooed. Tattooing ink into the skin can be unpredictable at times due to the nature and variances in skin types, therefore results can vary. We will do our best to tattoo your design to the best of our ability and advise you on the likely outcome if we see a potential problem with your tattoo.

  • Inform your tattoo artist about serious illnesses in the first conversation! Only then is it decided whether it is at all possible to tattoo you.
  • BRING I.D. If we ask for it, it’s because we can’t take the chance of tattooing someone who is underage. If you don’t have it and we ask for it, we will not be able to tattoo you and you will lose your deposit.
  • Please turn up five to ten minutes before you are scheduled to start.
  • Please make sure you have eaten and are well rested before you come in for your tattoo, and make sure you are not under the effects or feeling the after-effects of drugs or alcohol. If you are, we will not be able to tattoo you and you will forfeit your deposit.
  • Tattoo artists prefer working with clean people, please don’t ignore your personal hygiene.
  • No dogs or animals in the studio, please leave them at home.
  • It is your responsibility to remember your appointment date and time.
  • If you are running late due to unforeseen circumstances, please ring the studio.
  • Tattoo artists do have a life outside of the studio and on the very rare occasion we may need to re-schedule your appointment. If you choose not to re-schedule and have paid a deposit, this is the only instance that a deposit refund will be given.
  • You waive the right to privacy, in the event debt recovery is required or any other such reason.

We do not tattoo

  • Under 18s without legal consent
  • Pregnant Women. Tattooing during pregnancy and lactation is not recommended and is not practiced with us
  • Animals
  • Racist Remarks or Hate Symbols
  • Idiots

Artists, and other authorised representatives of Outside The Box Tattoos can refuse service to anyone, no explanation(s) needed.

Healing

Healing of the tattoo is the client’s responsibility. Each artist has their healing method and will advise clients on how to take care of their tattoo during and after healing. If you are unsure about healing your tattoo, contact us.

The following might occur due to normal causes or improper care:
  • Infections
  • Loss of ink
  • Fading
  • Allergic Reactions
  • Itching
  • Dryness
  • or other conditions that might arise.

*We do not take responsibility for any damage to the tattoo while healing or otherwise.

Our artists are professionals and will advise you on the care, placement, and size of your tattoo.  Whether you take their advice is up to you. We do not accept responsibility for any advice followed other than the advice given by Outside The Box Tattoos and its partners.

Deposits Policy

Deposits may be required to book an appointment to ensure the artist time and labour while designing your tattoo is covered.
Deposits are non-refundable but can be transferred to a re-scheduled appointment time if the following applies (and is at the discretion of the artist with whom the appointment has been made):

  • The appointment was cancelled 48 hours before the date.
  • Not showing up or cancelling with less than 48 hours to your appointment will result in losing your deposit.
  • If you arrive for your appointment, and we believe that you are under the influence of drugs or alcohol you will be refused service, asked to leave, and lose your deposit.

Design Policy

Copyright – All artworks and designs are fully owned by the artist who created them under the New Zealand Copyright Act.  You may not take a copy of any design in hard copy, digitally or by any other means, unless special permission is given by the artist.  The artist has the right to photograph and reproduce artwork for promotional purposes.  The artist has the right to resell a custom design only if the following conditions apply:

  • the original client agrees.
  • the original client who commissioned the design, didn’t result in getting it done as a tattoo (didn’t pay, changed their mind).

Your artist may require a drawing deposit before undertaking any design work on your behalf. This may be the same deposit to hold your booking.

Deposits are non-refundable

If you are not happy with the design your artist has provided, your deposit will not be refunded - the deposit is put down to pay for the artists time to create your design.

TERMS OF USE

Welcome to Outside The Box Tattoos website (“Website”). ‘Outside The Box Tattoos’ is the trading name of OTBSOLUTIONS.CO.NZ LIMITED. Outside The Box Tattoos, Partners, Staff, Agents, and Associates are as the context may require hereinafter jointly and severally referred to as ‘Outside The Box Tattoos’. To the greatest extent permitted at law, these terms of use (“Terms of Use”) apply to your use of the Website at www.tattoos.otbsolutions.co.nz (or such other URL as the Website may subsequently be hosted at), the software, documentation and any associated materials comprising or made available to you via the Website (the “Materials”) as well as any services offered or provided to you by Outside The Box Tattoos  or its nominated third parties via the Website (the “Services”).  By making use of any of the Website, Materials and Services, you are deemed to have read and agree to be bound by these Terms of Use.

AMENDMENTS

Outside The Box Tattoos reserves the right to amend these Terms of Use from time to time upon placing any such amendments on the Website or by providing you direct notice of any such changes. Your continued use of any of the Website, Materials and Services thereafter will be deemed to be acceptance by you of any such changes to these Terms of Use.

INTELLECTUAL PROPERTY

Unless otherwise stated in these Terms of Use, Outside The Box Tattoos are the owner or licensee of all rights including all copyright, trademarks and other intellectual property rights relating to or included within the Website, Materials and Services. For the avoidance of doubt this includes without limitation all intellectual property rights in respect of all graphics, logos, text, images and software relating to or included within any of the Website, Materials and Services.

LICENCE

Outside The Box Tattoos  grants you a limited licence (“Licence”) in accordance with these Terms of Use for the purpose of accessing, as applicable downloading, and making use of the Website, Materials and Services (or any parts of such as Outside The Box Tattoos  may make available to you from time to time) for your own personal and non-commercial use or your own general use in the context of your position as a client of Outside The Box Tattoos . Utilizing any form of automated software in relation to your access or use of the Website, Materials or Services is prohibited. Any contravention by you of these Terms of Use or any other terms or conditions notified to you by Outside The Box Tattoos, terminates the Licence Immediately.

RESTRICTIONS

Under no circumstances, without the prior written approval of Outside The Box Tattoos, may you adapt, reproduce, store, distribute, print, display, publish or create derivative works from any part of the Website, Materials or Services other than in accordance with the Licence. You may not use any data gathering and extraction tools or software to extract information from the Website or utilize framing techniques to enclose any of the contents of the Website. You may not use any meta tags or other hidden text which incorporate Outside The Box Tattoos name or any of its intellectual property including trademarks. Using any information or content included in or related to the Website, Materials and Services other than in accordance with the terms of the Licence is strictly prohibited. You agree to fully indemnify Outside The Box Tattoos for any loss or damage it may suffer in contract, tort, equity, statute, regulation or otherwise, including without limitation any economic loss, loss of turnover, profits, business or goodwill, whether direct or consequential as a result of your breach of the Licence, including, in respect of any third-party claims against Outside The Box Tattoos, its related parties, employees, contractors or agents.

While Outside The Box Tattoos has endeavoured to take all reasonable and appropriate care in the preparation of the content of the Website, Materials and Services and has no reason to believe that any information contained in any of the Website, Materials or Services is inaccurate, Outside The Box Tattoos does not warrant the accuracy, adequacy, or completeness of any information contained in any of the Website, Materials or Services and that such information is error free. Outside The Box Tattoos does not undertake to keep any of the Website, Materials or Services updated. To the greatest extent permitted by law Outside The Box Tattoos does not accept liability for any loss or damage which may result either directly or indirectly from reliance by you upon the accuracy or currency of information contained in any of the Website, Materials or Services, including without limitation where such loss or damage is a result of or contributed to by the negligence of Outside The Box Tattoos. The content of the Website, Materials and Services is not intended to serve as human resources, organisation development or legal advice. The Website, Materials or Services may contain links to other websites not controlled by Outside The Box Tattoos (“Linked Websites”). Outside The Box Tattoos is not responsible for the content or privacy practices associated with Linked Websites. Outside The Box Tattoos links with Linked Websites should not be regarded as approval or as an endorsement, of those Linked Websites, their operators or owners, or of any information, graphics, materials, products or services referred to or contained on those Linked Websites including further links contained on those Linked Websites, unless and to the extent stipulated to the contrary in these Terms of Use.

LINKS

If you provide a link to the Website, you agree that you will not use any Outside The Box Tattoos logo, trade mark or other proprietary graphic as part of such link without the express prior approval of Outside The Box Tattoos.

SUPPORT

Outside The Box Tattoos reserves the right to make support services available in relation to any of the Website, Materials and Services on such terms and conditions as Outside The Box Tattoos at its sole discretion deems appropriate and further reserves the right to alter, suspend or withdraw such support services as Outside The Box Tattoos at its sole discretion deems appropriate.

EXCLUSION OF WARRANTY

To the greatest extent permitted by law, under no circumstances will Outside The Box Tattoos , its employees, contractors or agents be liable to you in contract, tort, equity, statute, regulation or otherwise for any loss, damage, costs, legal costs, professional and other expenses of any nature whatsoever incurred or suffered by you or by any third party, whether direct or consequential (including without limitation any economic loss or other loss of turnover, profits, business or goodwill) arising out of any dispute or contractual, tortious or other claims or proceedings made by or bought against you which relate in any way to your access and use of any of the Website, Materials and Services, including without limitation in relation to any failure or omission on the part of Outside The Box Tattoos  to comply with its obligations as set out in these Terms of Use.

LIMITATION OF LIABILITY

To the greatest extent permitted by law, in the event that any limitation or provision contained in these Terms of Use is held to be invalid or unenforceable for any reason and Outside The Box Tattoos  becomes liable for any loss or damage that would otherwise have been excluded, Outside The Box Tattoos  maximum liability in contract, tort, equity, statute, regulation or otherwise for any loss, damages or injury directly or indirectly arising in respect of your access and use of any of the Website, Materials and Services is to be limited to $50 in New Zealand currency.

JURISDICTION

The provision and use of the Website, Materials and Services is governed by and is to be interpreted in accordance with the laws of New Zealand and, in all matters relating to or arising from your access and use of any of the Website, Materials and Services, you agree to submit to the exclusive jurisdiction of the Courts of New Zealand. If you are accessing or making use of any of the Website, Materials and Services from outside of New Zealand then you agree that you are entirely responsible for ensuring that your access and use of any of the Website, Materials and Services will not contravene any laws in your country.

FAILURE TO COMPLY

Outside The Box Tattoos accepts no liability for any failure to comply with these Terms of Use where such failure is due to circumstances beyond its reasonable control.

WAIVER

If Outside The Box Tattoos waives any rights available to it under these Terms of Use on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

SEVERABILITY

If any provision of these Terms of Use is held to be invalid, void, unenforceable or illegal for any reason, such provision shall be deemed to be severed from these Terms of Use, but only to the minimum extent necessary to avoid such issue and the remainder of any such provision as well as all other provisions of these Terms of Use shall continue in full force.

ENTIRE AGREEMENT

These Terms supplement any other agreement (including license agreements) you have with Outside The Box Tattoos and are binding in respect of any use of the Website. If there is any conflict between these Terms and any other agreement and/or specific terms of use relating to specific material, then the latter shall prevail.
